
Srinagar, Feb 11 (BAN) A civil suit seeking ₹100 crore in damages, along with a criminal complaint filed seperately which has been filed by Tabish Bukhari and Haris Hameed against Rakesh Handu through his counsel, Advocate Arzaan Dar.
An order copy which lies with the Buland Awaaz News (BAN) Reads that the matter was taken up by the competent court, where the plaintiff sought the grant of a temporary injunction pending disposal of the main suit.
In the petition, the plaintiff submitted that a prima facie case exists in his favour and that the balance of convenience also tilts towards him.
It was further argued that failure to grant interim relief would cause irreparable loss and injury to his reputation. An additional application under Order 39 Rule 3 of the Code of Civil Procedure (CPC) was filed, seeking exemption from issuing prior notice to the defendants before granting the temporary injunction.
The court has come to the immediate rescue to the plaintiff on account of the urgency shown and defendant being course and defamatory against the plaintiffs as such immediate order for restrain from circulating and making further videos has been passed and justice has been served to the plaintiff.–(BAN)
