Court Slams Delay in FIR Despite Clear Forgery Evidence, Warns Against Mockery of Law

Awami Reporter Desk

Jammu | 27 June 2025 – In a major embarrassment for Jammu & Kashmir’s crime investigation wing, the Court of Special Judicial Mobile Magistrate (Passenger Tax, Shops & Establishment Act) Jammu has issued a bailable warrant of ₹10,000 against Mr. Benam Tosh, SSP Crime Branch Jammu, for failing to comply with a court order directing the registration of an FIR in the JKPSC Assistant Professor recruitment forgery case.

The court, presided over by Hon’ble Ms. Jyoti Bhagat, passed the exemplary order while hearing Contempt Case No. 33/2024, titled Ajay Kumar v. SSP Crime Branch Jammu & Anr, related to grave allegations of document forgery and misrepresentation during the JKPSC selection process.

At the heart of the matter is Mohd Qasim Mir, S/O Mohd Raqeeb Mir R/O Kotian, Mendhar, accused of forging academic records, conference certificates, and tampering with official documents—allegedly leading to his selection as an Assistant Professor in Geography through fraudulent means under JKPSC Notification No. 10-PSC(DR-P) of 2017.

Despite a detailed court order in 2023 directing registration of an FIR and multiple representations to JKPSC, SSP Crime Branch, and Special DG Crime, no FIR was filed, forcing complainant Ajay Kumar to file a contempt petition.

The court, while referring to the landmark Lalita Kumari vs. Govt. of UP judgment, ruled that:

> “Since commission of cognizable offences is clearly made out, SSP/SHO Crime Branch, Jammu is directed to register FIR and investigate the matter forthwith.”

The court noted glaring contradictions in Qasim Mir’s records, including:

Attendance certificates at conferences where RTI records show he was present at GDC Mendhar.

Falsified NCC certificate, where his actual grade ‘C’ was allegedly tampered to ‘A’.

A forged B.A. marks card with the wrong parentage.

A suspiciously acquired ALC certificate.

Shockingly, Crime Branch’s own internal report submitted on 23.03.2024 acknowledged document manipulation, yet no FIR was lodged—raising serious questions of willful inaction.

The bailable warrant is seen as a clear warning from the judiciary that “state agencies cannot delay justice or ignore court orders with impunity.”

“This is a mockery of justice. When Crime Branch itself admits manipulation but doesn’t act, it reflects either gross negligence or deliberate shielding,” said a senior lawyer following the case.

The order also calls into question the internal accountability of Crime Branch, especially as it pertains to high-stakes public examinations where careers and trust in the system are at stake.

Ajay Kumar, the whistleblower and complainant, expressed hope:

> “This court order is a big relief. I fought alone for 2 years while they sat on my complaint. Now I hope FIR is finally registered, and justice is served.”

As of now, SSP Crime Branch has failed to comment on compliance. The warrant remains in force unless the FIR is registered and report submitted.
