Pahalgam, February 23 – In a glaring defiance of regulations, a hotel construction has resumed near a residential house at Lonepora Batakoot, despite an earlier notice issued by the Chief Executive Officer (CEO) of the Pahalgam Development Authority (PDA). The construction, which involves raising a plinth for a hotel, was initially halted two months ago when Notice No. 5052-53 dated September 2025 was issued. However, the work has now recommenced under the apparent negligence of the PDA staff.
The notice was issued under Section 7(1) of the J&K Control of Building Operations Act 1988, which mandates obtaining permission from the competent authority before any construction activity. The PDA had directed the landowner, Adil Ahmad Khawaja, resident of Dachkeward Batakoot, to cease the illegal construction, warning of strict action in case of non-compliance. Despite this, construction activities have resumed, raising serious questions about enforcement and vigilance by the PDA.

Local sources revealed that the construction is taking place in close proximity to the owner’s residential property, indicating a clear violation of the earlier directive. The resumption of work under the very noses of PDA officials has sparked outrage among locals, who question the transparency and efficacy of the regulatory authority.
The incident also raises concerns about the role of the enforcement staff responsible for monitoring and preventing unauthorized constructions in the ecologically sensitive area of Pahalgam. The resumption of construction activity not only defies the notice issued by the then CEO but also undermines the rule of law.
Ironically, the new CEO PDA Dr Illyas earlier assured Awami Reporter to crack down on violators, however, local residents are demanding answers about how construction has been allowed to continue despite the previous order. They are also calling for an inquiry into the role of the enforcement team and possible lapses in monitoring illegal constructions.
Sources within PDA suggest that the violator did not seek any fresh permission for the resumed construction, raising questions about whether local officials turned a blind eye or were complicit. The issue of illegal constructions in Pahalgam has been a persistent problem, with allegations of corruption and favoritism often linked to the regulatory authorities.
The situation demands immediate intervention from higher authorities to ensure strict enforcement of building regulations. Local environmentalists have also expressed concerns about the potential impact of unauthorized constructions on the fragile ecosystem of Pahalgam.
